1. Le Tribunal n'a connaissance d'aucune procédure judiciaire en cours ou terminée concernant le nom de domaine <auto-distribution.eu> (ci-après le "Nom de Domaine Litigieux").
2. Créée en 1962, la société AUTODISTRIBUTION (le "Requérant") est une société française membre d'AD International, appartenant au Groupe Autodis, leader de la distribution indépendante de pièces détachées pour véhicules légers et poids lourds en Europe de l'ouest. En France, la société AUTODISTRIBUTION emploie près de 5.500 personnes, avec plus de 240 fournisseurs référencés pour 350 marques d'équipements et plus d'un million de références en stock. Elle est spécialisée dans la distribution de pièces détachées, de peintures, de pneus et d'équipements et dans les services de garage et de réparations multimarques.
Le Requérant est propriétaire de plusieurs marques « AUTODISTRIBUTION » notamment :
- La marque française semi-figurative AUTODISTRIBUTION n° 1554818 déposée le 11 octobre 1989, pour les classes 2, 3, 4, 7, 8, 9, 12, 37 et 40, qui expirera le 11 octobre 2029 ;
- La marque française semi-figurative AUTODISTRIBUTION n° 3980771 déposée le 7 février 2013, pour les classes 12, 35, 37, 38, 39 et 42, qui expirera le 7 février 2033 ;
- La marque internationale semi-figurative AUTODISTRIBUTION n° 1179674, désignant l'Italie, le Maroc et la Pologne, déposée le 19 juin 2013, pour les classes 12, 35, 37, 38, 39 et 42, qui expirera le 19 juin 2033.
Le Requérant est également titulaire du nom de domaine <autodistribution.fr>, enregistré depuis le 10 octobre 1999.
Le 11 mars 2024, Monsieur Soumare Birane (le "Défendeur") a enregistré le Nom de Domaine Litigieux, qui pointe vers la page de stationnement du bureau d’enregistrement et a été utilisé dans le cadre d'une tentative d'hameçonnage.
3. Le Requérant soutient que :
a) Le Nom de Domaine Litigieux est identique ou similaire au point de prêter à confusion avec ses marques antérieures
Le Requérant soutient que le nom de domaine litigieux <auto-distribution.eu> est similaire au point de prêter à confusion avec ses marques et que l'extension ".eu" n'affecte pas le nom de domaine dans le but de déterminer s'il est identique ou similaire au point de prêter à confusion.
b) Le Défendeur n'a aucun droit ni intérêt légitime concernant le Noms de Domaine Litigieux
Le Requérant soutient que le Défendeur n’est pas identifié dans la base de données Whois comme étant connu sous le terme « AUTODISTRIBUTION ».
c) Les Nom de Domaine Litigieux a été enregistré et est utilisé de mauvaise foi
Le Requérant soutient que :
- compte tenu de sa réputation (il est une filiale du Groupe Autodis, leader de la distribution indépendante de pièces détachées pour véhicules légers et poids lourds en Europe de l'ouest et bénéficie d’une forte présence en France), le Défendeur a enregistré le Nom de Domaine litigieux en pleine connaissance de sa marque "AUTODISTRIBUTION", et ne pouvait donc pas l’ignorer au moment de l’enregistrement.
- le Défendeur a usurpé l’identité d’un employé du Requérant et utilisé le nom de domaine dans le cadre d’une tentative d’hameçonnage, en créant une adresse sur le modèle « […]@auto-distribution.eu » dans l’objectif de contacter un fournisseur/client en son nom. Par conséquent, le Requérant soutient que le Défendeur a enregistré le nom de domaine <auto-distribution.eu> principalement dans le but de profiter de la renommée du Requérant en créant un risque de confusion dans l’esprit du consommateur avec intention de le tromper.
4. Le Défendeur n'a pas soumis de réponse.
5. Aux termes de l’article 4, §4 du règlement (UE) 2019/517 du 19 mars 2019 (ci-après désigné le "Règlement") :
"Un nom de domaine peut [...] être révoqué et s'il y a lieu, transféré par la suite à une autre partie à la suite d'une procédure de REL [...] quand le nom en question est identique ou susceptible d'être confondu avec un nom sur lequel un droit est établi par le droit de l'Union ou le droit national et que ce nom de domaine :
a) a été enregistré par son titulaire sans celui-ci ait un droit ou un intérêt légitime à faire valoir sur ce nom ; ou
b) a été enregistré ou utilisé de mauvaise foi".
Il appartient donc au Tribunal d'apprécier, au vu des faits relatés et des arguments exposés par les parties, si les conditions d’application de l’article 4, §4 du Règlement sont remplies afin de décider si les Noms de Domaine Litigieux doivent ou non être transférés au Requérant.
I. LE NOM DE DOMAINE ENREGISTRE EST IDENTIQUE OU SUSCEPTIBLE D'ÊTRE CONFONDU AVEC UN NOM SUR LEQUEL UN DROIT EST RECONNU OU ETABLI PAR LE DROIT DE L'UNION OU LE DROIT NATIONAL

Au regard des pièces produites par le Requérant, il n'est pas douteux que le Nom de Domaine Litigieux soit susceptible d'être confondu avec le signe "AUTODISTRIBUTION" sur lequel un droit de marque est établi par le droit de l'Union (marque française semi-figurative AUTODISTRIBUTION n° 1554818, marque française semi-figurative AUTODISTRIBUTION n° 3980771, marque internationale semi-figurative visant l'Italie et la Pologne AUTODISTRIBUTION n° 1179674) au sens de l'article 4, §4 du Règlement :
- d'une part, l'enregistrement par le Défendeur du Nom de Domaine Litigieux, qui diffère de la marque et du nom de domaine du Requérant par l'insertion d'un tiret entre les termes "auto" et "distribution", est caractéristique d'une pratique de typosquatting ;
- d'autre part, l'ajout du suffixe ".eu" derrière la marque du Requérant n'affecte pas l'appréciation du risque de confusion dans le but de déteminer si le nom de domaine de second niveau enregsitrés par le Défendeur sont identiques ou similaires aux droits du Requérant.
Le Tribunal estime en conséquence que le Requérant rapporte la preuve que le Nom de Domaine Litigieux est susceptible d'être confondu avec les marques invoquées au soutien de sa requête et que la condition posée par le paragraphe B(11)(d)(1)(i) des Règles ADR est satisfaite.
II. LE NOM DE DOMAINE A ETE ENREGISTRE SANS QUE SON TITULAIRE AIT UN DROIT OU INTERÊT LEGITIME A FAIRE VALOIR SUR CE NOM
7. Aux termes du paragraphe B(11)(e) des Règles ADR, la preuve des droits du Requérant sur le nom de domaine litigieux ou de son intérêt légitime qui s’y attache aux fins du paragraphe B(11)(d)(1)(ii) peut être constituée, en particulier, par l’une des circonstances suivantes :
- Avant la notification du litige, le Défendeur a utilisé le nom de domaine ou la dénomination correspondant au nom de domaine en relation à une offre de biens ou de services, ou démontre avoir effectué des préparatifs à une telle démarche ;
- Le Défendeur, qu’il s’agisse d’une personne morale, d’une organisation ou d’une personne physique est généralement connu sous ce nom de domaine même s’il n’existe pas relativement au nom de domaine concerné un droit reconnu ou établi par le droit national et/ou par le droit de l’Union Européenne ;
- Le Défendeur utilise le nom de domaine de manière légitime et à des fins non commerciales et équitable, sans que son objectif soit d’induire le consommateur en erreur ou de porter atteinte à la réputation de la dénomination sur laquelle porte un droit reconnu ou établi par le droit national et/ou par le droit de l’Union Européenne.

Lorsque le Requérant établit prima facie que le Défendeur n’a ni droit, ni intérêt légitime, sur le Nom de Domaine Litigieux, la charge de la preuve de cet élément est renversée et c’est au Défendeur d’apporter des preuves pertinentes démontrant un droit ou intérêt légitime sur les Noms de Domaine Litigieux. Si le Défendeur n’apporte pas de telles preuves pertinentes, le Requérant est réputé avoir satisfait au deuxième élément.
9. Au regard des pièces communiquées au Tribunal, le Requérant établit l’absence de droit et d’intérêt légitime du Défendeur sur le Nom de Domaine Litigieux. Le Défendeur ayant renoncé à se défendre et n’ayant pas fait valoir l’existence d’un usage légitime du Nom de Domaine Litigieux, le Tribnual ne peut que conclure que la deuxième condition du paragraphe B(11)(d)(1) des Règles ADR est satisfaite.
Le Tribunal estime en conséquence que le Défendeur a enregistré le Nom de Domaine Litigieux sans droit ni intérêt légitime à faire valoir sur ce nom.
III. LE NOM DE DOMAINE A ETE ENREGISTRE OU UTILISE DE MAUVAISE FOI
10. De surcroit, il résulte des pièces versées aux débats que le Nom de Domaine Litigieux pointe vers une page inactive et que le Défendeur ne démontre aucune activité relative au Nom de Domaine Litigieux, ce qui est constitutif d'un usage de mauvaise foi (cf. par ex.: Bforbank c/ Chi Dang Vuong, CAC8551 <bfrbank.eu>; Bolloré c. Leroy Jean-Paul, CAC8052, <bollore-enrgys.eu>; Inbokss SIA v. Worldwide Trademarks BVBA, CAC 5892, <inbox.eu>; AXA v. Sylux Sylwester Domitrz, CAC5544, <axabank.eu>; Cork City Council v. Traffic Web Holding B.V., CAC3230, <cork.eu>; Sanofi v. Poussieres d'Etoiles, CAC6492, <oenobio.eu>).
11. Par ailleurs, la tentative d'hameçonnage réalisée à partir du Nom de Domaine Litigieux constitue indubitablement une utilisation de mauvaise foi avérée (cf. ELO c. Malfate F., OMPI DEU2023-0006, <auchan-order.eu>)
Le Tribunal estime en conséquence que le Requérant rapporte la preuve que le Nom de Domaine Litigieux a été enregistré de mauvaise foi par le Défendeur et que les conditions du paragraphe B(11)(d)(1)(iii) des Règles ADR sont satisfaites.

Dans la mesure où le Requérant est une société française, immatriculée au RCS de Créteil sous le numéro 962 227 351 et dont le siège social est situé 22, avenue Aristide Briand, 94110 Arceuil en France, qui remplit la condition d'éligibilité posée par l'article 4, §6 du Règlement, le Nom de Domaine Litigieux est transféré au Requérant.
Pour les raisons indiquées ci-dessus, conformément au § B12 (b) et (c) des Règles, le Tribunal a décidé de transférer le nom de domaine <auto-distribution.eu> au Requérant.
